Ohio's Court Structure
Ohio's court system has four levels: Municipal and County Courts (trial courts of limited jurisdiction), Courts of Common Pleas (general jurisdiction trial courts), District Courts of Appeals (intermediate appellate courts), and the Ohio Supreme Court. The amount in controversy, the type of case, and geographic location determine which trial court has jurisdiction. Appellate jurisdiction is determined by the district in which the trial court sits — Stark County cases appeal to the Fifth District; Summit County cases appeal to the Ninth District.
Ohio's Standards of Appellate Review
Ohio appellate courts apply different standards of review depending on the type of error alleged. Questions of law are reviewed de novo — meaning the appellate court decides the legal question fresh, without deference to the trial court. Factual findings are reviewed for manifest weight of the evidence. Discretionary rulings — evidentiary decisions, sentencing choices, and similar matters — are reviewed for abuse of discretion. Preserving Error for Appeal
Ohio appellate courts generally will not consider arguments that were not raised and preserved in the trial court. Plain error review is available for unpreserved constitutional claims in criminal cases, but it is a demanding standard that rarely results in reversal. Federal Habeas Corpus After State Conviction
Federal habeas corpus — governed by 28 U.S.C. § 2254 — allows a state prisoner to challenge their conviction or sentence in federal court on the ground that the conviction was obtained in violation of the United States Constitution. Federal habeas is not a substitute for direct appeal; it is available only after state remedies have been exhausted, and the grounds for relief are limited to federal constitutional claims.
