Ohio Civil Litigation: What You Need to Know

Ohio's Civil Court System

Ohio civil litigation is governed by the Ohio Rules of Civil Procedure, which prescribe the process for filing, discovery, motions, and trial. Most civil cases in Northeast Ohio are filed in the Court of Common Pleas — the general jurisdiction trial court — or in the Municipal Court for smaller-dollar claims. The amount in controversy, the type of claim, and the residence of the parties all affect where a case is properly filed and how it proceeds.

Personal Injury and the Two-Year Statute of Limitations

Ohio Revised Code § 2305.10 establishes a two-year statute of limitations for most personal injury claims. The clock typically begins running on the date of the injury. Missing the deadline — even by one day — permanently bars the claim regardless of its merit. In wrongful death cases, the two-year period under ORC § 2125.02 runs from the date of death. Early consultation with an attorney preserves the right to pursue the claim and allows time for proper investigation.
