Ohio Real Estate Law: What You Need to Know

Ohio Deed Types and Property Transfer

Ohio law provides for several types of deeds, each carrying different warranties of title. A general warranty deed provides the broadest protection, with the grantor warranting title against all prior claims. A limited warranty deed warrants only against defects arising during the grantor's ownership. A quitclaim deed conveys only whatever interest the grantor holds — with no warranties at all. Ohio Revised Code § 5302 governs the statutory forms for each deed type. Selecting the wrong deed type in a transaction can have significant consequences for the buyer's title protection.

Ohio's Residential Property Disclosure Requirements

Ohio law under ORC § 5302.30 requires sellers of residential real property to complete a detailed disclosure form covering the condition of the property's structure, mechanical systems, environmental conditions, and known defects. The disclosure obligation applies to most residential sales and imposes liability on sellers who knowingly fail to disclose material defects.
